Data Breach and Limitation of Liability

1. Limitation of Liability

Open Labs, LLC employs rigorous security measures to protect your sensitive information. However, by submitting your information, you acknowledge and agree that no system is entirely immune to risk. OpenLuxe shall not be held liable for any unauthorized access, disclosure, or loss of data resulting from events beyond its reasonable control, including but not limited to cyberattacks, breaches of third-party services, or force majeure events.

2. Arbitration Clause

Any disputes arising out of or relating to this policy, including claims of liability or damages related to a data breach, are governed by the Mandatory Arbitration and Class Action Waiver section of our Terms of Service, including the JAMS-administered individual arbitration in Cheyenne, Wyoming (or, for individual consumers, in the U.S. county of your billing address) and the 30-day opt-out window described there. In case of any conflict between this policy and the Terms of Service on dispute resolution, the Terms of Service control.
